Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.

"Since his return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her order.

The case stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to face human smuggling allegations, he was held in federal detention.

In her order, the court pointed out that the government lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
